Interpol Notice Lawyers in Israel

Interpol, or the International Criminal Police Organization, plays a critical role in global law enforcement by facilitating international cooperation among police forces. Established in 1923, Interpol operates as an intergovernmental organization with 196 member countries, including Israel. One of Interpol’s primary functions is to assist in extradition processes, ensuring that individuals who have committed crimes can be brought to justice, no matter where they attempt to hide. An interesting fact is that Interpol’s Red Notice, often referred to as an international “wanted persons” notice, is a powerful tool in international law enforcement and significantly influences extradition proceedings.

INTERPOL in Israel

Interpol Israel operates through the Israel National Central Bureau (NCB), which serves as the liaison between Israeli law enforcement and the global Interpol network. The NCB in Israel is integral to the country’s participation in international law enforcement efforts. The bureau utilizes Interpol’s secure global police communications network, known as I-24/7, to exchange crucial information with other NCBs and the General Secretariat.

NCBs like the one in Israel are pivotal to Interpol’s operations. They gather and share intelligence to support national and international investigations, contributing to the global fight against crime. In addition to working closely with local law enforcement agencies, the NCB in Israel collaborates with other NCBs and Sub-Bureaus worldwide, as well as the General Secretariat’s offices. This cooperation enables the effective exchange of criminal data and the coordination of cross-border investigations and arrests.

Frequently asked questions

Does Israel extradite its own citizens?

Yes. Israeli citizenship is not a bar to extradition. Where the person was both a citizen and a resident of Israel at the time of the offence, surrender is conditional on an undertaking by the requesting state that any sentence imposed will be served in Israel. A citizen who was not an Israeli resident at that time may be extradited without that condition, which makes residence at the time of the offence one of the decisive facts in such cases.

The first requirement is a legal basis: Israel extradites only where a treaty or a multilateral instrument applies between it and the requesting state. Beyond that, the usual grounds are the absence of dual criminality, the offence not meeting the threshold of an extraditable offence, its political character, the expiry of limitation periods, a prior acquittal or conviction for the same conduct, and the risk that surrender would be contrary to public order or to the person’s fundamental rights.

Jurisdiction lies exclusively with the Jerusalem District Court, which decides whether the person is extraditable. Its decision can be appealed to the Supreme Court, and only after the judicial stage is complete does the Minister of Justice take the final decision on surrender. The judicial and executive stages are separate, and arguments that fail before the court can still be raised to the Minister.

It is circulated to the national bureau and can trigger checks at the border and during immigration or citizenship procedures. A Red Notice is not itself an arrest warrant under Israeli law, and detention requires a domestic decision. The record nevertheless continues to exist independently of any court outcome, and removing it is a separate process from the extradition proceedings.

No. Acquiring Israeli citizenship does not bar an extradition request, and citizenship obtained after the alleged offence does not create the protection available to those who were citizens and residents at the time of the offence. Relying on repatriation as a shield is one of the more common and more costly misconceptions in this area.
